Cayman Islands Introduces Plant Protection Act, 2023

The Cayman Islands Government has passed the Plant Protection Act, 2023, a new legislation aimed at protecting local flora from pests that could be introduced through imported plants. The Act, which replaces the Plants (Importation and Exportation) Act (1997 Revision), addresses the growing threat to Cayman's native plants and trees from new plant pests, such as the mealybug and various polyphagous pests on Christmas trees. The new law imposes stricter regulations on the importation of non-native plants and trees, with penalties for breaches including up to two years in jail or a $50,000 fine. 🌿

The Plant Protection Act, 2023 establishes a system of permits for the import, export, and transit of plants, plant products, and other regulated articles. It also sets up an administrative and enforcement structure to handle pest outbreaks and other emergencies. The law is designed to enhance the protection of Cayman's cultivated and native plants by providing more robust national safeguards against alien plant pests. Moreover, it aims to facilitate safe and effective trade in plant and plant products. The new legislation aligns local laws with international phytosanitary (plant health) standards set by the International Plant Protection Convention. It also establishes a National Plant Protection Organisation and assigns the Department of Agriculture the responsibility of exercising the powers and performing the functions of the NPPO. 🌳

The Plant Protection Act, 2023 covers provisions for imports, exports, re-exports, and transits, as well as the mechanisms and authorizations for the control, eradication, and management of pests. It includes various declarations, such as quarantine or regulated pests, pest-free areas, quarantine areas, and phytosanitary emergencies.
